Restaurant Partner Terms

These terms apply to any restaurant that lists on Khajasaja and accepts orders through it. By submitting your restaurant for verification, or by accepting these terms when completing verification in your restaurant dashboard, you agree to them on behalf of the business you represent. If you do not agree, do not complete verification or accept orders through Khajasaja.
1. Relationship
Khajasaja is a marketplace that lists your menu and passes customer orders to you. Your restaurant is an independent business, not an employee, agent, or franchisee of Khajasaja. You are solely responsible for your menu, pricing, food preparation, food safety, and fulfilling every order you accept.
2. Verification
Before going live, and at any time afterward, Khajasaja may ask for your PAN or VAT number, business registration certificate, food/sanitation license, and the owner's citizenship certificate or ID for identity verification. You confirm that everything you submit is accurate and belongs to your business. Providing false or misleading information is grounds for rejection, suspension, or termination. Once submitted, these legal and identity details can only be changed by contacting Khajasaja support, so double-check them before submitting.
3. Commission and Fees
Khajasaja charges a commission on the subtotal of each order, at the rate shown in your restaurant dashboard. This rate is agreed before you go live and communicated to you before any change takes effect.
4. Payment and Weekly Invoicing
Khajasaja currently supports cash on delivery. You collect payment directly from the customer at delivery. Khajasaja invoices you weekly for the commission owed on orders delivered that week. You agree to pay each invoice within the grace period shown on it. Unpaid invoices past that grace period may result in your restaurant being suspended from taking new orders until the balance is settled.
You are responsible for keeping the payout details in your dashboard (bank account or eSewa/Khalti ID) accurate, since Khajasaja uses them for any refunds or adjustments owed to you.
5. Delivery
Khajasaja is an aggregator, not a delivery company. You confirm that your restaurant handles its own delivery, whether with your own staff or a delivery arrangement you manage. You are responsible for timely, safe delivery of every accepted order, and for the condition of the food on arrival. Khajasaja does not employ, supervise, or dispatch delivery riders and is not liable for delivery delays, damage, or loss once an order leaves your kitchen.
6. Menu, Pricing, and Food Safety
Menu items, descriptions, photos, and prices shown on Khajasaja must be accurate and kept up to date. You are responsible for complying with applicable food safety, hygiene, and sanitation laws in Nepal, and for holding any license those laws require. Khajasaja may ask you to update or remove a listing that is inaccurate, misleading, or unavailable.
7. Orders
You may accept or decline any order. Once accepted, you are expected to prepare and deliver it as described. Repeated rejections, cancellations, or unfulfilled orders may affect your standing on the platform.
8. Confidentiality of Your Information
Legal, registration, and owner identity details you submit are kept private and are not shown to customers or other restaurants. They are visible to you in your own dashboard and to authorized Khajasaja staff for verification, payout, and compliance purposes. Operational details you set yourself, such as menu pricing, delivery area, and hours, are shown publicly as part of your listing.
9. Suspension and Termination
Khajasaja may suspend or remove your restaurant for an unpaid invoice past its grace period, false or misleading verification information, repeated food safety or hygiene complaints, or a serious breach of these terms. You may stop taking orders and leave Khajasaja at any time by notifying support; outstanding commission on delivered orders remains due.
10. Limitation of Liability
Khajasaja provides the marketplace platform "as is." To the extent permitted by law, Khajasaja is not liable for losses arising from your food preparation, delivery, or business operations, or for indirect or incidental losses arising from your use of the platform.
11. Changes to These Terms
Khajasaja may update these terms as the platform grows. Material changes will be communicated through your restaurant dashboard, and continuing to accept orders after changes are posted means you accept the updated terms.
12. Governing Law
These terms are governed by the laws of Nepal. Any disputes will be subject to the jurisdiction of the courts of Pokhara, Nepal.
